Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BluTally mobile application ("App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

We reserve the right to modify these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use BluTally. If you are under 18, you should review these Terms with a parent or guardian.

3. Account Registration

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password secure and not share credentials with others
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Permitted Use

BluTally is provided for legitimate scientific field data collection, ecological research, and biodiversity conservation. You agree not to:

• Submit false, fabricated, or misleading scientific data
• Use the App for any commercial purpose without prior written consent
• Attempt to gain unauthorized access to the App or its backend systems
• Reverse engineer, decompile, or disassemble any part of the App
• Upload viruses, malicious code, or any harmful software
• Violate any applicable local, national, or international law or regulation

5. Intellectual Property

5.1 App Ownership

BluTally and all its content, features, and functionality are owned by BluTally and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose.

5.2 Scientific Data Ownership

All scientific and environmental data submitted through the App — field observations, species records, measurements, GPS coordinates, and photographs — becomes the exclusive intellectual property of BluTally upon submission. By submitting data, you irrevocably assign all rights to that data to BluTally for research, conservation, and publication purposes.

5.3 User-Generated Content

By submitting photographs or media, you grant BluTally a perpetual, worldwide, royalty-free licence to use, display, and distribute such content for conservation and research purposes.

6. Privacy

Your use of the App is governed by our Privacy Policy, incorporated into these Terms by reference.

7. Google Play Store Terms

These Terms are between you and BluTally only — not with Google LLC. Google has no obligation to provide maintenance, support, warranty, or liability for the App. Your use is also subject to Google Play Store Terms of Service.

8. Third-Party Services

The App integrates with Google Sign-In and Google Maps. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party practices.

9. Disclaimer of Warranties

BluTally is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or reliable. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, BluTally shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

11. Indemnification

You agree to indemnify and hold harmless BluTally from any claims, damages, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or data you submit.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms. All provisions that by their nature should survive termination shall survive, including IP provisions and limitations of liability.

13. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
